Subject Divorce in Korea

Hello,

I was married here in Korea back in December 2015. We are both USA citizens and only have registered our marriage here. My husband has abandoned me since last year November 2016. I would like to get a divorce here in Korea since we were married here. is this an easy process?

Hello,

As both of you are non-Korean, what you can do in Korea is “조정 이혼 Adjusted Divorce”, which is similar to “협의 이혼 Divorce by Agreement”. But both of you should be in Korea for the application for the divorce. Neither the third party nor your own lawyer are eligible to apply for your divorce. And “조정 이혼” means ending your marriage in Korea, so I cannot give you a guarantee whether this divorce can be acknowledged in either America or Russia. You need to ask your own country the details of divorce procedure in your own country. You have to visit 가정법원 (Family court) in your area.

Thank you.
